Chapter 29 - Federal Election Commission

  • Ensure new Republican FEC commissioners share views on not overregulating political activity.
  • Negotiate with Democratic Party leaders to temper choices for opposition party commissioners.
  • Direct the Department of Justice to only prosecute clear violations of the Federal Election Campaign Act (FECA).
  • Instruct DOJ not to prosecute individuals under interpretations of the law that the FEC disagrees with.
  • Direct DOJ to consult and consider all official FEC actions when making prosecution decisions.
  • Instruct DOJ to defend the FEC in all litigation when commissioners fail to authorize the agency's general counsel to do so.
  • Consider recommending that Congress amend FECA to remove the FEC's independent litigating authority.
  • Request FEC commissioners prepare guidance on statutory provisions and regulations that have been changed or voided by court decisions.
  • If the FEC fails to act, direct the attorney general to prepare a guidance document on changed or voided provisions and regulations.
  • Prioritize nominations to the FEC once commissioners reach the end of their terms.
  • Support legislative language to eliminate or limit commissioner overstays.
  • Vigorously oppose efforts to change the FEC structure from six to five commissioners.
  • Raise contribution limits for political donations.
  • Index reporting requirements to inflation.
  • Consider changes to relax restrictions on party committees' ability to coordinate with their candidates.
